Accepting these terms
These terms apply when you use this website or hire G&R Midland Concrete and Masonry for work at your property. By browsing the site, calling us, sending a request through our contact form or signing an estimate, you agree to them.
If you don't agree with any part of these terms, please don't use the site or book work with us. If a written estimate or contract for your job says something different from this page, the signed document wins for that job.
Who we are and the work we do
G&R Midland Concrete and Masonry is a masonry contractor in Midland, TX, and we also do concrete work. Our services include foundation repair, chimney and brick repair, tuckpointing, retaining walls, block walls, pavers, walkways, stone veneer, fireplaces and outdoor kitchen masonry. You can read more about our crew on our About page.
The descriptions on this site explain what each job usually involves. They aren't a promise about your job, because what we do at your house is set by the written estimate we give you after we've seen it.
Estimates and pricing
We give free in-person estimates with no obligation to hire us. Your estimate lists the work we've agreed to do, the materials and the price, based on what we could see and measure on the visit.
Masonry and concrete work sometimes turns up problems that can't be seen until the job is open, such as damaged block behind brick, rotted framing, buried debris or soil that won't hold a base. If that happens, we'll stop, show you what we found and give you the added cost in writing before we do any extra work.
An estimate stays good for the period written on it. After that, material prices can change, so we may need to update the price before we schedule the job.
Scheduling, weather and cancellation
We'll give you a start date once you approve the estimate, and we'll tell you how long the job should take. Start and finish dates are our best estimate, not a guarantee, because rain, wind, extreme heat or cold, material delays and permit timing can all push a job back.
We won't pour concrete or lay mortar in weather that would weaken the work, even if that means moving your date. We'll let you know as soon as we can when a delay is coming.
If you need to cancel or reschedule, please call us at (432) 219-3791 as early as you can. If we've already ordered special materials for your job or started work, you may owe for those materials and for the work done up to that point, as your estimate or contract sets out.
Payment terms
Your estimate or contract states what you owe, when it's due and any deposit we need before ordering materials or starting work. On larger jobs, payments may be split by stage of the work.
Final payment is due when the work in your contract is complete unless your contract says otherwise. If a payment is late, we may pause further work until it's settled, and we keep any rights Texas law gives contractors to collect unpaid amounts for work done on a property.
Your part as the property owner
You agree to give our crew safe access to the work area, to tell us about anything we should know before we start, such as sprinkler lines, private utility lines, septic systems or property line questions, and to confirm you have the right to have the work done on the property.
If a permit or an approval from a homeowners association is needed for your job, we'll talk through who handles it before work begins. Any damage caused by hidden items you knew about and didn't tell us about isn't our responsibility.
Our guarantee and its limits
G&R Midland Concrete and Masonry is licensed and fully insured, and we stand behind our work with satisfaction guaranteed on every job. If something we built or repaired isn't right, call us and we'll come back to look at it and make it right.
Some things are the nature of the material and aren't defects. Concrete can get fine hairline cracks as it cures and settles, new brick, stone and mortar won't match old work exactly in color or texture, and a white powder called efflorescence can show up on masonry as moisture works out of it.
Our guarantee doesn't cover damage from soil movement or settling we didn't cause, drainage problems outside our scope of work, flooding, storms, vehicles heavier than the work was built for, chemicals such as deicers, lack of upkeep, or changes and repairs made by someone else. Beyond what's written here and in your contract, we make no other warranties, stated or implied, to the extent Texas law allows.
Limits on our liability
To the extent Texas law allows, our total liability for any claim tied to a job is limited to the amount you paid us for that job. We aren't liable for indirect or follow-on losses, such as lost rent, lost business, loss of use of your property or emotional distress.
Nothing in these terms limits liability that the law doesn't allow a business to limit, including liability for our own gross negligence or willful misconduct.
Using this website
The information on this site is general and meant to help you understand masonry and concrete work. It isn't engineering advice, and it doesn't replace an on-site look at your property. Photos show past work and may not look exactly like your finished job.
The text, photos and logos on this site belong to G&R Midland Concrete and Masonry, and you may not copy them for commercial use without our written permission. Links to outside sites are there for your convenience, and we aren't responsible for what those sites say or do.
Settling a disagreement
If you're unhappy with any part of our work or billing, please tell us first, because most problems get fixed fastest with a phone call and a visit to the job. Reach us at (432) 219-3791 or through our contact page.
If we can't work it out together within 30 days, both sides agree to try mediation with a neutral mediator before going to court, with the cost of the mediator split evenly. If mediation doesn't settle it, either side may take the matter to a court with proper jurisdiction in Midland County, Texas.
Governing law
These terms, and any job we do for you, are governed by the laws of the State of Texas, without regard to rules that would apply another state's law.
If a court finds any part of these terms can't be enforced, the rest of the terms still apply.
Changes to these terms
We may update these terms from time to time, and the version posted on this site is the one in effect. Changes won't apply to a job already covered by an estimate or contract you've signed, unless we both agree in writing.
Using the site after a change means you accept the updated terms.
Questions about these terms
If anything here is unclear, call us at (432) 219-3791 or send a note through our contact page, and we'll explain it in plain terms before you book. You can also head back to our home page to see the work we do around Midland.
